End-User License Agreement & Terms of Service

1. Nature of Software and Decentralized Runtime Liability

The Licensor (mediaXtreme LLC, hereinafter "TitiLisa") provides the software application strictly on an "as-is", self-hosted basis. The Licensor does not operate, control, host, or maintain the Virtual Private Servers (VPS), hosting containers, proxy networks, or endpoint sessions deployed by the licensee.

All computational logic, network requests, media data ingestion (including YouTube Shorts extraction), and account automation loops are executed solely at the command, direction, and risk of the licensee. The Licensor explicitly disclaims any association with, or liability for, the accounts managed or automated via the software.

2. Compliance with Third-Party Platform Policies

The Licensee acknowledges that automated interactions, mass account synchronization, and content syndication via headless browser interfaces may directly violate the Terms of Service, Developer Policies, or Community Guidelines of third-party platforms, including but not limited to:

  • TikTok (ByteDance)
  • Instagram / Facebook (Meta Platforms, Inc.)
  • YouTube / Google (Alphabet Inc.)
  • LinkedIn (Microsoft Corporation)

The Licensee assumes 100% responsibility for any administrative restrictions, shadowbans, account flags, permanent suspensions, or legal penalties imposed by third-party social networks resulting from the execution of the software.

3. Mass Automation and Interaction Nest Limitations

The software includes features that allow the configuration of internal account matrices ("Satellite Rings" or "Interaction Clusters"). The Licensee certifies that they:

  • Own, possess explicit lawful authorization for, or hold valid operational control over all profiles, credentials, and session cookie data sets imported into the system.
  • Will not utilize the software to coordinate unauthorized sybil attacks, spam campaigns, or malicious impersonation.
  • Accept full legal responsibility for all automated actions executed through their self-hosted deployment.

4. Infrastructure Node Isolation

Each TitiLisa deployment operates as a fully isolated compute node. The central SaaS platform provides licensing, authentication, and update distribution only. The Licensor maintains zero visibility into:

  • The Licensee's social media account credentials or session tokens
  • Automated posting schedules, target content, or engagement campaigns
  • Proxy configurations, VPS specifications, or network topology
  • Any data processed, stored, or transmitted by the edge runtime

5. Operational Legal Safeguard

By operating mass interaction matrices on your self-hosted TitiLisa node, you acknowledge that you are solely responsible for compliance with regional communication laws, data protection regulations (GDPR, CCPA, LGPD, etc.), and third-party platform API policies. The software developers hold zero visibility into your data layer and zero liability for endpoint profile suspensions.

6. License Scope

The TitiLisa Core License grants the Licensee a perpetual, non-exclusive, non-transferable right to deploy one (1) production instance of the software on self-owned or self-leased infrastructure. Redistribution, resale, sublicensing, or public sharing of the source code is strictly prohibited and will result in immediate license revocation.

7. Limitation of Liability

In no event shall mediaXtreme LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation: loss of profits, data, goodwill, social media accounts, advertising revenue, or business opportunity, arising out of or in connection with the use or inability to use the software, regardless of the cause of action or theory of liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which mediaXtreme LLC is incorporated, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration.

9. Amendments

TitiLisa reserves the right to modify these Terms at any time. Continued use of the software following any modification constitutes acceptance of the updated Terms. If an over-the-air update introduces new automation features, the dashboard UI will require re-acceptance of the updated legal terms before any worker container resumes automation jobs.
